General Terms and Conditions (GTC)

Kaleidoscop Aesthetic AG, Tödistrasse 7, 8002 Zurich

1. Scope

These GTC govern the contractual relationship between the patient (hereinafter referred to as 'patient') and the operator of the practice (hereinafter referred to as 'practice') for consultations, medical aesthetic treatments, aesthetic surgery, and applications with medical lasers and energy-based systems.

2. Conclusion of contract and scope of services

A contract is concluded when an appointment is made (online/by telephone/in writing) and accepted by the practice. The specific scope of services is determined by the medical indication, information provided, consent given, and the individual treatment plan. The practice is obligated to provide professional treatment in accordance with recognized medical standards, but is not obligated to achieve a specific aesthetic result.

3. Appointments, delays, no-shows

Appointments are binding. In the event of a delay, the treatment time may be shortened without a reduction in remuneration, or the appointment must be rescheduled.

Appointments that are not canceled in time cause additional work and will be charged as follows (placeholder):

  • Cancellation < 24 hours before appointment: CHF 200 (including consultation appointments).
  • No-show: CHF 200 or 50% of the scheduled treatment fee.
  • Surgery/procedure appointments: Cancellation < 14 days: 50% of the agreed fee; cancellation < 24 hours: 100%, or the full amount.

Note: These flat rates are designed as compensation for expenses. The patient reserves the right to prove that the damage was less than this amount; the practice reserves the right to prove that the damage was greater than this amount.

4. Prices, cost estimates, payment

Prices are based on the current price list or an individual quote. Unless otherwise agreed, fees and material costs are due immediately after the service has been provided. A deposit may be required for procedures. Refunds will only be made in the event of a proven erroneous double payment or if a service has demonstrably not been provided.

  • Deposit/reservation fee: no later than 14 calendar days before the date of the operation.
  • Payment of the full amount: no later than 14 calendar days before the date of the operation.
  • Remaining amount: no later than 10 calendar days before the date of the operation.

5. Information, consent, obligations to cooperate

A prerequisite for any treatment is adequate medical information and effective consent. The patient undertakes to provide complete and truthful information about their state of health, previous treatments, medications (including dietary supplements), and allergies, and to report any changes immediately. The patient must follow instructions for pre- and post-treatment and attend agreed check-ups.

6. Results, risks, complications

Aesthetic results are individual and depend on biological factors, initial findings, aftercare, and the healing process. No guarantee or warranty for a specific result or freedom from complications is given. Despite careful execution, side effects and complications may occur (including swelling, hematomas, pain, infections, scars, pigmentation changes, burns, asymmetries, intolerances, and visual disturbances in periocular procedures). If medically necessary, an adjustment of the procedure, a referral, or emergency treatment may be required.

7. Liability

The practice is only liable for damages in cases of intentional or grossly negligent breach of duty and within the scope of mandatory statutory liability provisions. In cases of slight negligence, the practice is only liable—to the extent permitted by law—for breaches of essential contractual obligations and limited to foreseeable damage typical for this type of contract. Liability for indirect damage, consequential damage, loss of profit, pure financial loss, or immaterial impairment (e.g., dissatisfaction with the aesthetic result) is excluded to the extent permitted by law. Mandatory rights of the patient remain unaffected.

8. Data protection, professional secrecy, electronic communication

The practice treats patient data confidentially and is subject to professional secrecy. Personal data is processed in accordance with the Federal Act on Data Protection (FADP, revised) and other applicable regulations, in particular for the purposes of treatment, administration, billing, quality assurance, and fulfillment of legal obligations. Where necessary for organizational reasons, contractors (e.g., IT hosting, laboratory, billing) may be used, each of whom is contractually bound.

The patient may consent to electronic communication (e-mail, SMS, telephone, messenger, video) after receiving information. The practice points out that despite appropriate security measures, residual risks (e.g., misdelivery, unauthorized access) may exist. The patient may change their preference at any time.

9. Photo/video documentation

Photos/videos may be taken for documentation, progress monitoring, and quality assurance purposes. Use for teaching, publication, or marketing purposes will only take place with separate, express consent and may be revoked at any time for the future. Revocation does not affect the legality of processing that has already taken place.

10. Online offers / Website liability

The information on this website is for general information purposes only and does not replace medical advice or examination. To the extent permitted by law, the practice accepts no liability for the accuracy, completeness, or timeliness of the website content. To the extent permitted by law, no responsibility is accepted for the content of external linked sites.

11. Final provisions

Swiss law applies. The place of jurisdiction is Zurich. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. The practice may amend these GTC for objective reasons; the current version will be made available (website/PDF in the practice).
